Terms of Service

Effective date: October 14, 2026 · Lumina Mindspark LLC

These Terms of Service (“Terms”) govern your use of the Lumina Mindspark website and enrollment in our online design and creative skills courses, packs, and Studio Pass. By submitting an enrollment request or accessing course materials, you agree to these Terms.

1. Company and offerings

Lumina Mindspark LLC provides structured online lessons and practical learning materials in areas such as UI/UX and web design, motion graphics basics, logo and brand identity, digital illustration, photo editing, typography, color systems, and portfolio presentation. Prices shown on the site are starting list prices in USD for the described starting scope. We may update catalog prices; the price confirmed at checkout or in our enrollment reply controls.

2. Eligibility

You must be able to form a binding contract in your jurisdiction and be at least 16 years old (or the age of digital consent where higher). If you enroll on behalf of a business, you represent that you have authority to bind that business.

3. Enrollment process

Website forms are enrollment requests, not instant checkout unless we configure payment links. We confirm availability, payment instructions, and access next steps by email or phone. We may decline an enrollment that appears fraudulent, incomplete, or outside our capacity.

4. License to course materials

Upon confirmed payment and access grant, Lumina grants you a personal, non-exclusive, non-transferable license to view lessons and use practice materials for your own learning. You may not resell, publicly redistribute, sublicense, or scrape course videos or files, or share login credentials. Work you create for practice remains yours; Lumina retains all rights in our curriculum, branding, and teaching materials.

5. Feedback quotas and turnaround

Where a course lists written feedback, it is limited to the stated quota (for example, one practice brief or one image set). Feedback is educational commentary, not professional design services for client delivery. Turnaround depends on volume; we aim for reasonable business-day responses after materials are received in the requested format.

6. Software and third-party tools

You are responsible for obtaining any software licenses needed to complete exercises. Lumina does not provide Adobe, Figma, or similar seats unless explicitly stated in writing for a specific offer.

7. No guarantees of outcomes

We do not guarantee employment, freelance income, client acquisition, platform acceptance, or specific skill timelines. Courses are educational; results depend on your practice, prior experience, and market conditions. We do not claim university accreditation or professional licensure.

8. Acceptable use

You agree not to:

  • Attempt unauthorized access to our systems or other learners’ accounts
  • Upload malware, harassing content, or unlawful material in submissions
  • Misrepresent Lumina materials as your original commercial course product
  • Use the site to spam or scrape personal data

We may suspend access for violations without refund where misuse is clear.

9. Payments

Fees are due as stated in the enrollment confirmation. Taxes may apply based on your location. Packs and the Studio Pass are billed as described at purchase; monthly passes renew until canceled under the Refund & Access policy.

10. Intellectual property

Site content, course curricula, trademarks (including Lumina Mindspark), and visual assets are owned by Lumina or our licensors. Concept craft imagery on the site may be generated or staged for atmosphere and is not a claim of client case studies.

11. Disclaimer of warranties

The site and courses are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free access.

12. Limitation of liability

To the fullest extent permitted by law, Lumina’s total liability arising from these Terms or any course is limited to the amount you paid us for the specific offering giving rise to the claim in the twelve months before the claim. We are not liable for indirect, incidental, special, consequential, or lost-profit damages. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

13. Indemnity

You agree to indemnify and hold harmless Lumina and its officers from claims arising from your misuse of the site, violation of these Terms, or infringement of third-party rights via content you submit.

14. Governing law

These Terms are governed by the laws of the State of Montana, United States, without regard to conflict-of-law rules. Exclusive venue for disputes is the state or federal courts located in Montana, unless applicable consumer law requires otherwise.

15. Changes

We may update these Terms. Material changes will be reflected by a new effective date. Continued use after changes means you accept the updated Terms where allowed.
